Rear Spoiler Failure

Its been around everywhere but I've noticed my problems a bit different.

Its in the up position. Usually when I got these codes they reset when i turned the car off and on but now before I even start the motor the code comes on...

I'm going to try to just reset it with the battery and see where that takes me... I've never had it where it wouldnt go away once i shut the car off but this is like an Engine Light where it will pop up before i even start up the car.

i cant see it committing suicide or i really hope it doesnt because i just bought this new less than 6 months ago. its gone away and hasnt come back... im just hoping that its because of the severe cold here and the dirt...
