Agree 100%. Fight it. When the officer gets on the stand ask him if his ears are calibrated for calculating 95 db +/-. Then ask what brand decible meter he used or was he just guessing. Ask whether he recorded the sound so he can play it for the court. Ask whether he crawled under the car to inspect the muffler and on and on and on...

i got stop few weeks ago for the same thing,my exhaust was loud he said when i ask him why he stopped me
But my sticker was expired so he gave me a ticket for the sticker only!

The reason these tickets are rarely given is that they actually require a certain amount of proof, which most cops are too lazy or disorganized to properly collect. They give out the ticket on the chance that people will just pay. Don't pay, shove those tickets right back up the MAN'S A**.

Dude, neither you nor I should give a crap about what he SAID.... it is what he WROTE on the ticket that defines how you defend yourself. Take it into a referee for a smog equipment check and you might be thinking 'wow, I wish I paid the fine'
All citations will list a section of the vehicle code that you are charged with violating... this is usually VC then 5 numbers then some letters.....

I have had this happen to me. I took it to a smog referee station and it was determined that the exhaust was NOT too loud.
Be sure your car will pass smog or does not have any outward visible modifications to the motor, headers, kats, etc.
When I took my Dinan M3 with supercharger in, there was no issue. All the did is check for the loudness of the exhaust. They certified it as legal. I brought it into the judge and the ticket was dismissed.

Smog referee stations can be funny places, depends on where it is (ie what CARB District you are in) and what they are used to seeing.
In CA to be "legal" it needs to have a California Air Resource Board (CARB) listing... this means the mfg has had it certified to pass emissions and loudness.

My friend who has a VW R32 got the same ticket for a stock exhaust. It's EASILY beat, especially with the info that you gave us.
When the cop went to the front of the car, you shoulda told him, it's one of those new electric Porsche's.
Good luck on your fight, should be an easy win, but more of an inconvenience. Also, I'd do it all through the mail for convenience factor.

went to the smog referee i'm at about 106 decibles, which is louder than the law allows.would this ticket be counted as a moving violation? i'm thinking about just changing it out for the stock exhaust system, and just say it's been stock all along.
