My AMG C55 got major league rear ended today. (Guess it was bad mojo to think about selling it.) Anyway, I think it's totalled but if not, does anyone know a good dimished value claim attorney or appraiser in southern cali. PM me or post to the board. Thanks guys.

When my vette got into an accident the ins.co. from the other party was open to a DV claim. All they asked for was an assessments from two independent inspectors. Once I presented them with the expert's opinion, they paid on the spot.

Sorry to resurrect an old thread, but for anyone else who goes down this path there is California case law to support a claim for diminished value on a car: In Brown v. Roland (1940) 104 P.2d 138, 141, the court said that “where an automobile is susceptible of repair, [] the damages include . . . the actual depreciation due to the injury”.

Old case, but still good law last time I checked.

This is good information to have. Many people do not know about claiming diminished value.

I've had two cases involving diminished value- one on a Bentley Continental GT Coupe and the other on a Ford GT. In both cases, the diminished value was a large figure.

Both insurance companies initially denied that they were obligated to pay diminished value, but after hiring an appraiser and showing them the law, they gave in.

Mine is also is playing possum "diminished value...I am not familiar with that?? However we will give you $20 dollars a day to rent a car while we fix your Mercedes."

That is almost enough to rent a Toyota Yaris. Time to get a lawyer involved.
