Negherbon Porsche in Oakland, CA wants to keep my $5,000 deposit

I put a $5,000 deposit on a Turbo Cab eight weeks ago and was told by Paul at Negherbon Porsche in Oakland it was fully refundable.

Last Friday I called to inquire about a refund because I bought a Turbo Cab at another dealership.

Paul by now had changed his story and said I'll get my refund once the car comes in and has been sold.

That sounds like a bunch of %#@& to me. I have gotten deposits back from other dealers before without a discussion.

After mentioning this to one of my friends he said he had problems about four or five years ago getting his $5,000 back. He said it toook him half a year of constant phone calls.

I'll have to pull out the big guns right now to not let this get out of hand. I think I'll call Porsche, the Better Business Bureau, and the file a fromal complaint with the DMV to complain about Negherbon Porsche's practices. I found the form on the DMV website.

Who has had a similar problem and what do you recommend I do?

That is illegal in the State of California. Picketing the dealership would draw alot of bad attention. I would immediately file in small claims court. Or get an attorney and see if you can get your $5,000. plus attorney fees.

Negherbon sounds like a bad place to do business. The law is the law. They are aware of it. It sounds like they are simply jacking you around.

Why don't you post their e-mail address and the guys name. I'm sure many of us would send them a letter telling them exactly what we think of their illegal practice.

Thats unreal over $5k they are willing to lose a customer and get bad press, such poor business tactics.
