Just my luck......
So last week, I was heading home from work after a sh***y day and I stop behind this Toyota pickup truck at a red light. The bed of this truck was piled full of.......crap, where he could not see anything behind him. When the light turned green, the pickup moves forward a slight bit and then puts the truck into reverse. Before I could honk or stick my car in reverse, the truck backs right into my car and the back of his truck slides straight onto my front hood. There weren't any witnesses around. The driver did admit fault at the scene but there's nothing down on paper. I also called the police (so they can come out, inspect the scene, and work up a police report) but apprantely, it's not worth LAPD's time.
After filing a claim with his insurance carrier (Farmer's), the driver told Farmer's that he was stopped at the light when I rear-ended him. Because of his statement, Farmer's denied by claim and they told me to file a claim with my own insurance carrier (Mercury). I'm supposed to give a recorded statement tomorrow when Mercury calls.
First of all, I don't know if Farmer's is bluffing. All I can do is hope Mercury can find out what exactly happened by inspecting the damage. Is there any way they can tell that the guy backed up into me by inspecting the damage? I'm also considering consulting an attorney....is this a good idea? It pisses me off that some guy can back into me, cause $8000 worth of damage, and I can still be found at-fault for this. Any advice would be appreciated. Thanks!

I can hardly believe what I just read. What a moron that guy was and a F-ing liar too. I feel for you. It really pisses me off hearing about this. I wish I had some good advice for you. Just get it fixed and put it behind you. My experience in dealing with this kind of situation is the good guy loses.

Sorry to hear about this. I would get a copy of the police report when you called. I think you should be fine...considering that if you had rear ended him, he would have called the cops to say he was rear ended, but he never did.

Well hopefully everything comes out alright in the end, but this might be the perfect opportunity to get that lightweight CF hood. A lot cheaper than fixing or replacing the original hood when you take into account the work and paint needed.

these day, no one is honest and everyone says what's convenient for them. you have to get the police to produce a report stating the pickup driver admitted he backed into you. next time this happens, call yourself and leave a voicemail with the driver admitting fault. this is the best evidence since you have no idea whom the cop sides with.
