So I got into a bad accident on 5/30 a guy turned in front of me and i t-boned him and drove him into another car. My airbags didnt even go off?!?! Needless to say Hartford insurance-(the guy's insurance that caused the accident) looked at my car and said that there is est. $29,000 in damages and it is a structure total. I was not issued a ticket in the collision but he was for failure to yield. Nothing in the police report states anything at all about me being at fault in anyway at all. It states that he suddenly pulled in front of me and i could not avoid the collision. And it also states that all 6 witnesses relate the same incident. Well now his insurance company says that 2 witnesses say that i may have been speeding because i passed them on that road before the accident. but none of this is in the police report!!!! So his insurance says they will cover 60% of damages and my cars value is $40,470. So considering im not going to cover the other 40% i made a claim with my insurance company(Allstate insurance). Allstate looked at the car and is telling me that they can fix it for $16,000 and its not totalled. So i said ok i want to take it to my body shop which specializes in porsche, audi, ferrari, etc. Allstate then says well they charge to much here are the shops you can take it to......... So basically if you have ALLSTATE and drive a porsche or any type of car over $40,000 I recommend you get different insurance because they refuse to pay what it costs to properly fix a porsche. Anyone ran into this problem i need help?????????????????

Man, Im sorry to hear this. One word "nightmare". Insurance is supposed to relieve the stress and get you comparably back on the road, not F with you and your emotions. Unfortunately I do not have any advise. Good Luck!

insurance companies will try anything in order to avoid payment. submit it to your insurance company and their legal department will over after the other guys insurance company. police report says it all.
this is why you pay your premiums. your insurance company is there to protect you in these situations.
and yes, get a body shop recomendation from your local authorized porsche dealer. a body shop that works on high end cars will have a good relationship with the adjuster, who the insurance company relies on for its information.

If you had an estimate from Hartford for $29,000 and an estimate from Allsnake for $16,000... isn't there a problem here? Put the two estimates side by side to compare. I guarantee the Hartford estimate is probably closer to legitimate than Allsnakes. Did Allsnake find a used front clip rescued from hurricane Katrina? I don't know but to have 2 diff ins. companies $13,000 apart is waay off balance; talk to your lawyer. Depending on the year, mileage, etc... your car might be a total loss; however, you should be compensated for your loss.
The insurance company is required to put you in the position you were before the accident. Once an estimate begins to approach 70% of the cars value, most companies will consider it a total loss. They know from experience, if they have an ESTIMATE for $29,000, the final bill will usually end up around 15% - 20% higher than the original, so they total the car and pay you what the car was worth before the accident. (That part is always debatable) There are always unforseen items that will come up durring the repair process; ex... A pinched wire harness between the front trunk and the dash; new wire harness... $4000 plus labor. That's just one example, I'm sure there are more.
I dunno, I suppose if the original hood on your car had bent corners where someone dropped it, and bubbling rust paint underneath, and cakes of mud in the bolt holes, then yea, it would be ok to buy that used hood from 1300 miles away to save $50
Seriously, I can't spell, and you as an insurance carrier (your car), must be put back to pre-accident condition ~ demand it

Try your insurance...
I'd get your own insurance company to go after the at-fault party's insurance to pay 100%
They are just trying to jerk you around. Ask for written statements from the witnesses that show them saying you were speeding, and then ask what formal qualifications they posses to judge speed.
Tell them to put up or shut up.

Tell Allstate you want to fix at the shop of your choice or they need to make it total loss. Tell Hartford that you'll go after loss of value if they don't fork out all the money, it's going to take sometime but be assertive and don't give up. Good Luck!

Assuming you weren't speeding; anyways, it was not in the police report so presumably you weren't. I don't think you should claim from your insurance. The report states that the other person was totally at fault so keep bugging their insurance. They could've just made up those 'other witnesses' saying you were speeding but the fact is the police report didn't state anything like that. You should only claim from your own insurance if you were fully/partly at fault. Your insurer should help you succeed in your claim against the other insurer instead of just agreeing with them if your case is as you've stated.

I'm not sure how things work in Illinois, but in CA, we can take our car to the shop of our choice - Per the CA Dept of Insurance. I would check with your state insurance department and find out what your rights are. I also agree with Tranquility. There is nothing in the report about your speeding. The official record is the police report and the other party was cited. I would put them on a short leash and then get an attorney ASAP if they fail to respond.

Yes, in Ca...we can take our cars anywhere....I was rear ended and they said they wanted me to use a certain shop, I said no...then they wanted to repair my bumper and told my shop to do that instead of replacing it...I said no, they quickly said ok..new bumper...They will tell you anything...you have to be firm and say, "This is what I want...period.".
