FWIW, when I purchased my '09 off-lease, I was told that I could CPO the car under the following two scenarios:
  1. At lease end
  2. By "selling" the car to the dealer and then "buying" it back
Outside of lease-end, I do not think you can typically have the car CPO'd without the dealer taking possession. I have some mods and I would have been required to return the car to stock for the CPO, so it was not worth the cost/hassle. I think the cost was about $7K but I do not remember for certain.
