If it's your daily driver, you won't be compromising as much as you think getting a 335i. Not to mention you can get the exact one you want.

i prefer SMGII over VW's DSG. the DSG is just too smooth. SMG feels like i'm driving a race car in the neck snapping S6 mode.
If i were to choose, I'd take the E92 335i. Since I already had 3 M3, and still got 2 of them.

Get the 335 with the $2,000 dinan upgrade. Perfect for anyone with this debate. I bought my S5 about a week before Dinan announced their software and the stats behind it. While I love the looks of my S5, the 335 w/Dinan would have been a tough choice...had I known it was an option, not sure which direction I would have gone in. (I was trading in my E46 M3 and miss it alot for what it's worth).

Owned a 2004 M3 6-speed, silver grey on black.
Although the 335i is new, they're everywhere (at least in LA), and to the untrained eye look just like a 328i.
You're right in stating that an M car will always be an M. Even though there are plenty of E46 M3's around as well, no one mistakes it for a regular 3 series. The M3's inline six and chassis are world renowned.
Even though I'm extremely happy with the C4S, I still miss the M3, a sentiment shared by many Porsche owners here who used to own a E46 M3.

I have to agree, that car in particular looks very busy with that type of wheels. It needs a more settled look for such color. You should let the car sell it self by it's color, not the wheels int his car.
