well the selling dealer is being difficult in that they want me to pay 200 bucks to get it shipped to them and have no guarentee that this will be covered. they say that if the car has been overreved the warranty can be voided. So I have no confidence that they will say anything different than the dealer the car is at right now. They are also saying that although they told me that the car was under warranty that it can be voided anyways. I will try to contact PCNA today and if not I informed the selling dealer that I will end up taking legal action against them for misrepresentation. I will not get cheated out of anything and although it might cost me more in legal fees, i refuse to get screwed over by a lying dealer. This is going to turn into a nightmare and I feel it, but I will keep you all posted as to what happens

how do cars that are cleary tracked affect the warranty?
i thought i remembered reading something a while back that there is some warranty disclaimer that allows them to void the warranty at their discretion if the car has been tracked.

they are all bouncing off limiters except for I guess one milisecond misshift at 134hrs or so(which was way before I bought the car). When I bought the car they informed me of that one shift and said it would not effect my warranty. If they had been truthful I would have not bought the car. Anyways this is going to prove to be hell for me so I am going to fight it to the death.

Well clearly they misrepresented the car to you in that they DL'd the over rev and then very clearly verbalized that it would not adversely effect the warranty. That statement and the fact that the car was still under factory warranty would lead any rationale buyer to believe (rightfully so) that it was covered. Stick to your guns, unless you admitted to track duty or they have some other evidence of abuse, IMO they will have to eat it. The only question is will they do it now and retain your business or will they do it later under the order of a judge.
Personally as a business owner, even if I were wrong, a $1000 bucks would not be enough to make me want to screw a customer or risk my good reputation. Good will goes a very long way.
