Having issues with insurance claim

So I don't know much about insurance stuff, but I'm having an issue with the other party's insurance not paying for my claim. The body shop has been calling them for the pass couple of days, but no one calls back. I tried calling, but I didn't get a call back. What can I do so that they will pay for the claim? I've been without my car for over a month, and rental charges are adding up and I'm afraid the insurance company might not pay for all of it.

Is your own insurance company involved? Typically they would be involved I'd think, and working with the other company to ensure that everything was handled properly. Even though you're not at fault, I believe sometimes your own insurance company could pay and then pursue reimbursement from the other company, and that includes rental car expenses too (which typically will only be extended for 30 days depending on your policy). Exactly. Did you call your own insurance company to report the issue? They should be handling everything, not you.

Sounds like you don't want your insurance company involved (I wouldn't). The less they know the better. You might have to initiate a lawsuit against the driver that caused the accident. their insurance company will step in to defend that person and will be forced to fix your car either by settling or a judgement.

He got rear ended IIRC. Completely not at fault. Why would he not want his insurance company involved. That's what they're there for.

Yeah they are, but it will go on his record as an accident even though it was not his fault.

^ Yup, even though I was not at fault, my premiums will go up. I already spoke with my insurance, and they told me to go through the at-fault party's insurance. And Haury's told me that I could sue the drive who hit me, or I can be a pest and call the insurance company daily till they pay.

Edit:

I did that math for labor and parts. For parts, its not that much of a difference from the insurances estimate and the body shops, but labor makes up for most of the bill. The damage was significant, much worse than the insurance originally estimated.

Being a pest does not seem to be working. File the suit and the insurance comapny will probably settle with you in no time. The suit will get them to move on the claim. Otherwise they will drag it out for ever.

Well they just told me about this on Friday, and I've read online this insurance company is a bit slow in the CR department. I'm going to be calling the two agents that were assigned to me tomorrow to see if they will do anything. It seems like the adjuster isn't being reasonable, and that is who the body shop is calling.

i have no idea if it works, but i'm told filing complaints with the state insurance commissioner's office breaks some logjams. as i was told, these complaints get tracked and the insurance companies have to report back on resolutions.

hopefully, i'm not spreading and urban myth, but WA state's insurance commission office has a reputation of being pretty hard to deal with, so if you can sick them on a company that's hosing you, that's probably good.

How long is "Over a month"? If it's been just over a month, that's actually not that long for a wreck of that nature.

they should pay for your rental car costs as long as your car is being repaired.

find an attorney that won't cost you. most attorney won't cost you anything. they will go after the other insurance company for other damages such as bodily, loss of income etc. the attorney will get your settlement quick. trust me, you don't want to handle this yourself.

I got hit May 26th, and repair didn't start till two weeks later because the insurance was never approving repairs. When they did, Haury's found more damage then what was quoted before. It has been done since the 9th..
